This is a non-personal services contract to provide quality assurance

representative (QAR) services. Contracts may include request for quality

assurance services on civil works, general and military construction,

dredging, or services and supply contracts. The Government shall not

exercise any supervision or control over the Contractor employees

performing the services herein. Such contract service providers shall be

accountable solely to the Contractor who, in turn, is responsible to the

Government. Work to be performed does not fall under the Brooks Act.

Under this contract, the Contractor is prohibited from performing

architect-engineer type services that require professional registration or

design-related services, which require supervision by a registered

professional. The Contractor is prohibited from performing survey or

mapping services associated with architect-engineer type planning,

development construction, design, or alteration of real property.

Services shall not be provided which are considered closely related to

inherently governmental functions. Under no circumstances will this

Contract be utilized in a manner which would require the Contractor to

manage or direct another Contractor, nor in a manner such that the

Contractor might influence official evaluations of other Contractors directly

or indirectly. Contract personnel have no authority to over-ride the terms

of a construction project administered by the USACE, direct the

construction personnel in their work activities, or to modify or change the

construction requirements in any way for projects on which they are

providing quality assurance inspection services.

The Contractor shall provide all personnel, equipment, supplies, facilities,

transportation, tools, materials, supervision, and other items and nonpersonal

services necessary to perform quality assurance services as

defined in this Performance Work Statement (PWS), and within each task

order, except for those items specified as Government furnished property

and services. The Contractor shall perform to the standards in this contract

and each task order.
